Our Services (including Data Genie) are provided to businesses either as a fully hosted SAAS service or as an enterprise deployment. This Privacy Policy applies to both the fully hosted SAAS service model and the enterprise deployment model.

WE DO NOT SELL YOUR PERSONAL INFORMATION, NOR DO WE INTEND TO DO SO. WE DO NOT GIVE ACCESS TO YOUR PERSONAL INFORMATION TO THIRD PARTIES EXCEPT TO SUBPROCESSORS TO ASSIST US IN THE PROVISION OF OUR SERVICES TO YOU.

What information do we collect?

When you use, access, or register on our Website, we collect personal information (also referred to as personally identifiable information (“PII”) and “Personal Data”), which may include your first and last name, online contact information such as your business email address, phone number, persistent identifier, and other personal information.  If Data Genie is deployed into your system (i.e., the enterprise deployment model), you (i) agree to let us know in advance if you are giving us access to Personal Data to be processed and (ii) you represent and warrant that you have the authorization of the individual whose Personal Data is being processed to disclose such Personal Data to us. The information so collected will be stored on our servers. We collect the following information when you register on our Website:

a) Account Information. When you use, access, or register on our Website, we may also collect information that does not personally identify you such as your browsing history, search history, and interactions with our Website.

b) Financial Information. We currently do not collect or store any credit cards or bank information.  However, we will update this Privacy Policy when we start using and storing such information. We will also inform you via reasonable means if we start collecting such information from you.

c)Third Parties.  We collect information from third parties such as business partners.  We collect name and email ID of customer’s personnel who will use Data Genie.

How do we collect information?

We collect personal information from you in the following ways:

a) At registration on our Website; In email, text, and other electronic messages between User and our Website;

‍b) When User interacts with our advertising and applications on third-party website and services, if those applications or advertising include a link to this Privacy Policy;

c) When User subscribes to a newsletter; From User’s responses to a survey; From forms filled out by User; From records or copies of correspondences (including email addresses) if User contacts us; From search queries on our Website; and When User posts information to be published or displayed on our Website. How do we protect information we collect?

Our Website is hosted by GoDaddy. Our Website receives regular security scans, penetration tests, and malware scans and also uses an SSL certificate as an added security measure, as provided by GoDaddy (additional information is provided here: https://my.godaddy.com/web-security). We require username and passwords for our employees who can access the personal information of Users that we store and/or process on our Platform and servers. In addition, we actively prevent third parties from getting access to the personal information of Users that we store and/or process on our servers. We will implement reasonable security measures every time you (a) enter, submit, or access your information, (b) register, or (c) access our Website.

Data security measures

Security Measures. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Website. Fair Information Practice Principles. In the event of a personal data breach, we will notify the User within three (3) days via (i) email and/or (ii) our Website. Other Disclosure of Personal Information.

We will disclose personal information to comply with any court order, law, or legal process, including to respond to any government or regulatory request. We do not sell, trade, rent, or otherwise transfer personal information to others, unless we provide you with advance notice. This does not include our hosting partners and other parties who assist us in operating our Website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We provide non-PII (disaggregated and depersonalized) to third parties for marketing, advertising, and other similar purposes.

Google, as a third-party vendor, uses Cookies to serve advertisements to Users on our Website. Google uses first-party Cookies, such as Google Analytics Cookies, to compile Website data regarding User interactions with ad impressions and other ad service functions as they relate to our Platform. We currently use Google Analytics to collect and process certain Website and App usage data. Your california privacy rights

Code Z does not sell, trade, or otherwise transfer to outside third parties your “Personal Information” as the term is defined under the California Civil Code Section § 1798.82(h). Additionally, California Civil Code Section § 1798.83 permits Users of our Website that are California residents to request certain information regarding our disclosure of their Personal Information to third parties for their direct marketing purposes. Coppa compliance (for children under 13 users only) 

The Children’s Online Privacy Protection Act (“COPPA”) is a federal legislation that applies to entities that collect and store “Personal Information,” as the term is defined under COPPA, from children under the age of 13. We are committed to ensure compliance with COPPA. Our Website is not meant for use by children under the age of 13. Our Website does not target children under the age of 13, but we do not age-screen or otherwise prevent the collection, use, and personal disclosure of persons identified as under 13. California Consumer Privacy Act

Provide you a different level or quality of goods or services. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. Financial Incentives. However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.  Contact Information. We will not sell your Personal Information if you are under the age of 16 unless we have the consent of your parent or your guardian nor will we sell it if you ask us not to do so. Opt Out Right.  Although we do not currently sell your Personal Information, if we do so in the future, then upon your request, we will stop selling your Personal Information (sometimes called your Opt Out Right). Personal Information that We Store.  For your information, we store/collect the following Personal Information on you including your first and last name, online contact information such as your email address, phone number, and other Personal Information as provided in this Privacy Policy.

This Section supplements the information contained in our Privacy Policy above and applies to all visitors, users, and others to our Website, who reside in the State of California (“consumers” or “you”). We adopt this Section to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this Section.   Right to Request Personal Information. Upon request, we will provide you with (i) a list of all Personal Information that we have collected on you, (ii) from whom we obtained such Personal Information, (iii) the reason why we collected such Personal Information, and (iv) with whom (if any) we have shared such Personal Information. We do not use others to provide us with your Personal Information.  Disclosure of Personal Information. We only share your Personal Information with service providers, e.g., billing and collection agents, who enable us to provide our Services to you. We do not sell or give your Personal Information to third parties for purposes unrelated to our provision of Services to you. Right to have Personal Information Deleted. Upon request, we will delete all of your Personal Information that we have collected on you and will direct our Service Providers to also delete all of your Personal Information. But note that if we do delete all of this Personal Information, you will no longer be able to use our Services. Non-Discrimination Right. We will not discriminate against you for exercising any of your CCPA rights. We will not: Deny you goods or services. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

CAN-SPAM act of 2003

The CAN-SPAM Act establishes requirements for commercial messages, gives recipients the right to have businesses stop emailing them, and spells out penalties for violations.  We do not currently send periodic emails, but if we decide to in the future, per the CAN-SPAM Act, we will: not use false or misleading subjects or email addresses;  identify the email message as an advertisement in some reasonable way; include the physical address of Code Z Inc., which is 103 Carnegie Center, Suite 300, Princeton, New Jersey 08540, United States; monitor third-party email marketing services for compliance, if one is used; honor opt-out/unsubscribe requests quickly; and give an “opt-out” or “unsubscribe” option. Territorial restriction

Our Website is available for use and access worldwide. If you are a resident in the United States of America (“US”), you must comply with our Terms of Use and our Privacy Policy. Code Z reserves the right, at its sole discretion, to change or modify this Privacy Policy at any time. We will inform you about the modifications on our Privacy Policy page via Website or by a comparable means within a reasonable time period.  Your continued use of our Website and Services shall constitute your consent to such changes.
